1. Introduction

Welcome to Qben  (“Qben”, “Company”, “we”, “us”, or “our”).

These Terms and Conditions (“Terms”) govern your access to and use of:

  • Qben Customer Application
  • Qben Restaurant Application
  • Qben Delivery Partner Application
  • Website and all related services

(collectively referred to as the “Platform” or “Services”).

By accessing, registering, or using the Platform, you agree to be legally bound by these Terms. If you do not agree, please do not use the Services.


2. Eligibility

  • You must be at least 18 years of age to use the Platform
  • If under 18, use is permitted only under supervision of a parent/guardian
  • You agree to provide accurate, current, and complete information

Qben reserves the right to suspend accounts that provide false or misleading information.


3. Nature of Services

Qben is a technology platform that facilitates connections between:

  • Customers (end users)
  • Restaurant partners (food providers)
  • Delivery partners (logistics providers)

Qben does not prepare food, does not own restaurants, and does not directly provide delivery services. All transactions are executed between users, restaurants, and delivery partners.


4. User Accounts

  • Users must register with valid details
  • You are responsible for maintaining confidentiality of your login credentials
  • Any activity under your account is your responsibility
  • Unauthorized use must be reported immediately

Qben reserves the right to suspend or terminate accounts in case of misuse.


5. Orders and Transactions

  • Orders placed through the Platform are considered final and binding
  • Prices, availability, and menu items are determined by restaurant partners
  • Qben is not responsible for incorrect listings provided by restaurants

Once an order is placed, it is transmitted to the restaurant for preparation and processing.


6. Payments

  • Payments can be made via UPI, debit/credit cards, wallets, or other supported methods
  • Payment processing is handled through third-party payment gateways
  • Qben does not store sensitive payment details

Users agree to provide valid payment information.


7. Cancellation and Refunds

  • Cancellation policies vary depending on order status
  • Orders may not be cancelled after preparation has started
  • Refunds are processed as per the Refund & Cancellation Policy

Qben reserves the right to approve or reject refund requests after verification.


8. Responsibilities of Customers

Customers agree to:

  • Provide accurate delivery details
  • Be available to receive orders
  • Not misuse the platform
  • Not engage in fraudulent or abusive behavior

Failure to comply may result in account suspension.


9. Responsibilities of Restaurant Partners

Restaurant partners agree to:

  • Provide accurate and updated menu information
  • Maintain food quality, hygiene, and safety standards
  • Comply with all applicable laws (FSSAI, GST, etc.)
  • Ensure timely preparation of orders

Qben is not responsible for food quality or hygiene.


10. Responsibilities of Delivery Partners

Delivery partners agree to:

  • Provide valid identity and vehicle documents
  • Deliver orders safely and within reasonable time
  • Follow traffic laws and safety guidelines
  • Maintain professional conduct

Qben may suspend partners for misconduct or non-compliance.


11. Prohibited Activities

Users are strictly prohibited from:

  • Using the platform for illegal purposes
  • Attempting to hack, disrupt, or misuse services
  • Providing false or misleading information
  • Engaging in abusive behavior toward other users

Violation may result in legal action and account termination.


12. Intellectual Property

All content on the Platform, including:

  • Logos
  • Designs
  • Software
  • Content

is owned by Qben or licensed to Qben and protected under applicable laws.

Users may not copy, modify, or distribute content without permission.


13. Limitation of Liability

Qben shall not be liable for:

  • Food quality or safety issues
  • Delays caused by restaurants or delivery partners
  • Technical errors or downtime
  • Losses due to incorrect user input

Use of the platform is at your own risk.


14. Indemnification

You agree to indemnify and hold Qben harmless from any claims, damages, or liabilities arising from:

  • Your misuse of the Platform
  • Violation of these Terms
  • Breach of applicable laws

15. Suspension and Termination

Qben reserves the right to:

  • Suspend or terminate accounts
  • Remove content
  • Restrict access

if users violate these Terms or engage in suspicious activities.


16. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how your data is collected and used.


17. Third-Party Services

The Platform may include third-party services such as:

  • Payment gateways
  • Analytics tools
  • External integrations

Qben is not responsible for third-party actions or policies.


18. Force Majeure

Qben shall not be held liable for failure or delay due to events beyond control, including:

  • Natural disasters
  • Government actions
  • Network failures
  • Strikes or emergencies

19. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the jurisdiction of courts located in Uttar Pradesh, India.


20. Changes to Terms

Qben reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform.

Continued use of the Services indicates acceptance of revised Terms.
